Service Agreement

The Response Monsters Service (the Service) refers to any service, free or paid, offered on the Response Monsters website.

This is a document is a legal agreement between you and Response Monsters. Ordering the Response Monsters Service or signing up for a free account of the Service constitutes your agreement with the terms and conditions of this Agreement. If you do not agree with all of the terms and conditions of this Agreement, please do not order the Service or sign up for a free trial of the Service.

If your email address rejects or bounces back incoming email it is subject to being banned from the Service. You agree not to use the Service with conjunction with FFA (Free-For-All links page) or any other similar concept. Response Monsters tracks IP address with every activity and may institute legal action and or report any abuse to the proper authorities.

The Service may be used for lawful purposes only. Submission, transmission or storage of pornography and sex-related content and merchandising and/or any material in violation of any international, federal or any state law or regulation is expressly prohibited. 

Response Monsters exercises no control whatsoever over the information and data passing through any of its facilities.

Response Monsters does NOT allow any of its members to send unsolicited e-mail 'Spam'. Any form of Electronic Spamming referencing Response Monsters is strictly forbidden, including but not limited to unsolicited email, Bulk E-mail, or Inappropriate newsgroup posts. Response Monsters reserves the sole discretion of determining what constitutes Spam. Any of our members accused of any incident of Spam that links to the Response Monsters website will lose their account plus any commissions or membership contributions due to them. Response Monsters may at its discretion, press legal charges due to Spam. 

Response Monsters allows its members to make email contact with personally referred members to encourage them to upgrade to GOLD or be active resellers. 

By submitting your ad to the Service, you agree to receive occasional email from Response Monsters. These may involve matters of interest to all our clients, like upgrades. DO NOT submit your links if you disagree with this.

You agree not to provide false or misleading information on the Service. This includes, but is not limited to, providing false name and or e-mail address. Any commissions due will be paid to the name on your file in our database. It is your responsibility to keep your contact details including current email and mailing address updated at all times. Response Monsters cannot be held responsible for lost commissions due to inaccurate personal details.

If you are dissatisfied with any aspect of the Service or with any of our terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the Response Monsters Service.

If you order the GOLD membership and your payment is by credit card, you authorize Response Monsters to charge the credit card listed on the subscription form. The charge to your credit card may be a monthly recurring charge or may be a one-time charge depending on the payment plan you choose.

All paid services are only offered after payment has been received in advance. Paid accounts will be terminated if any payment reversal or refund takes place.

Paying customers are entitled to 30-day money back guarantee. No refunds can be issued after 30 days after purchase. Response Monsters will only issue refunds to customers who provide their transaction number (or order ID). This is always provided when every transaction is approved. The account name must also be provided. Refunds cannot be issued for reasons other than dissatisfaction RESULTING FROM FAILURE OF RESPONSE MONSTERS TO PROVIDE THE SERVICE AS DESCRIBED ON THE RESPONSE MONSTERS WEBSITE. Response Monsters will not issue a refund after services have been rendered. In cases where only partial services may have been rendered, only the amount corresponding to the percentage of service not yet rendered can be refunded, less any commissions that may already have been paid out to the referring Resellers (Affiliates).

Any paid Response Monsters Service may be terminated with an e-mail message. The transaction number (or order ID) and account name must also be provided. Termination will take effect only when the receipt of the termination request has been received and confirmed by Response Monsters Billing Department, billing@responsemonsters.com.

Commissions will be paid by the 15th day of each month for the previous month's commissions to all Resellers who have accumulated total earnings of $50.00 or more. Any commissions less than $50 in any given month will be carried forward until they accumulate to $50 or more.

Reseller/Affiliate Agreement
I understand that all dollar amounts posted on the Response Monsters websites are potential and not actual and that Response Monsters makes no claims that its Resellers will achieve such levels of commissions. I also agree that I am an independent contractor and therefore fully responsible for determining my own business activities, and will bear full responsibility for the consequences of these actions. Further, I understand that I am not an employee or legal representative of Response Monsters, and that I will not attempt to present myself in such a way as to mislead others into believing that I am an employee or legal representative of Response Monsters. I understand and agree that I am responsible for the payment of all federal and state self-employment taxes and any other taxes that may be required under federal, state, or any regulatory or taxing authority.

I also understand and agree that Response Monsters reserves the right, in good faith, to alter service prices and compensation plan without prior notice. Response Monsters reserves the right not to pay Reseller commissions to any Reseller who defaults to any of the policies stated on this agreement.

Disclaimer of Warranties, Limitation of Liabilities, Indemnification
THE RESPONSE MONSTERS SERVICE IS DISTRIBUTED ON "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED.

RESPONSE MONSTERS WILL NOT BE HELD RESPONSIBLE FOR ANY LOSSES, DAMAGES OR COSTS THAT YOU AND/OR YOUR BUSINESS MAY SUFFER WHEN USING THE ADSATURATION SERVICE. IN NO EVENT SHALL RESPONSE MONSTERS BE LIABLE FOR ANY LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT HOWEVER ARISING, INCLUDING NEGLIGENCE. BY USING THIS SERVICE, YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. YOU ALSO AGREE TO HOLD US AND OUR SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING ATTORNEY FEES MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.

RESPONSE MONSTERS RESERVES THE RIGHT TO ACQUIRE COURT FEES, ATTORNEY FEES AND ANY OTHER FEES ALLOWED BY LAW FROM ANY INDIVIDUAL OR ENTITY WHO BRINGS FORTH A LAWSUIT AGAINST RESPONSE MONSTERS RESULTING FROM USING THE SERVICE. OUR LIABILITY TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO $100.

If you break any of these rules & conditions, we reserve the right to terminate your membership and you will forfeit any refund of membership fees or commissions earned. We may also make changes to these rules and regulations with a 15-day notice to our existing members.
